License Framework

Tacticool Art uses a platform-managed licensing framework designed to provide clarity, commercial usability, marketplace consistency, and buyer protection.

This framework explains how digital products, license types, vendor submissions, exclusive products, and optional ownership transfer requests are handled within the Tacticool Art marketplace.

Platform-Managed Licensing

Tacticool Art manages the licensing structure used across the marketplace.

Vendors select the applicable product category or license type when submitting their products, while Tacticool Art administers the corresponding buyer-facing license terms.

This approach helps provide a consistent and understandable licensing experience for buyers and sellers.

Commercial Use by Default

All product categories on Tacticool Art are intended to support commercial use, subject to the applicable license terms and restrictions.

Buyers may use purchased products for commercial projects, branding, merchandise, creative production, client work, marketing materials, or other permitted uses under the applicable license.

Specific usage rights and restrictions may vary depending on the license type.

Vendor Ownership

Vendors retain ownership of their original submitted artwork unless a separate ownership transfer agreement is completed.

By submitting and publishing products on Tacticool Art, vendors authorize the platform to apply, issue, and administer the applicable license terms based on the selected product category or license model.

Purchasing a product does not automatically transfer copyright ownership, authorship rights, trademark rights, or other intellectual property ownership to the buyer.

Buyer License Rights

When a buyer purchases a product, the buyer receives usage rights according to the applicable Tacticool Art license framework.

The license determines what the buyer may do with the purchased files and what restrictions apply.

Unless expressly stated otherwise, buyers receive license rights only, not full ownership of the original artwork.

License Types

Tacticool Art may offer different license models depending on the product category and marketplace settings.

The main licensing models may include:

  • Non-Exclusive Commercial License
  • Exclusive Commercial License
  • Optional Ownership Transfer

Non-Exclusive Commercial License

A Non-Exclusive Commercial License allows the buyer to use the purchased product for commercial purposes under the applicable license terms.

Non-exclusive products may be sold to multiple buyers.

This means that other buyers may also purchase and use the same product under their own license.

Exclusive Commercial License

An Exclusive Commercial License is intended for one buyer only.

After an exclusive product is purchased, it should be removed from future marketplace sales or otherwise restricted from being sold again under the same exclusive model.

Exclusive purchase grants exclusive commercial usage rights under the applicable license, but it does not automatically transfer copyright ownership unless a separate ownership transfer agreement is completed.

Optional Ownership Transfer

Ownership transfer is not included by default with standard purchases, including exclusive purchases.

A buyer who has purchased an eligible exclusive product may request an optional ownership transfer.

Any ownership transfer request is subject to platform review, vendor approval, negotiation between the buyer, vendor, and platform, and a separate written agreement.

Additional fees, custom terms, portfolio rights, confidentiality terms, and transfer scope may be determined during the ownership transfer process.

What Buyers May Generally Do

Subject to the applicable license terms, buyers may generally use purchased products for:

  • Commercial projects
  • Branding and identity work
  • Merchandise and apparel design
  • Marketing and promotional materials
  • Client projects
  • Creative production
  • Digital and print applications
  • Modification or adaptation for permitted uses

General Restrictions

Unless expressly permitted by the applicable license or separate agreement, buyers may not:

  • Resell the original purchased files as standalone digital assets
  • Redistribute, share, upload, or sublicense the source files
  • Claim authorship of the original artwork
  • Use the product in unlawful, misleading, or harmful ways
  • Extract, repackage, or resell the design as a competing digital product
  • Transfer the license to another party without permission
  • Misrepresent the ownership status of the artwork

Exclusive Integrity

Tacticool Art takes exclusive licensing seriously.

Vendors listing products as exclusive are expected to ensure that the product has not been previously sold as exclusive to another party and will not be resold, relicensed, duplicated, or privately transferred in violation of the exclusive license.

If a buyer discovers a suspected exclusive licensing breach, the buyer may submit an Exclusive Integrity Claim for review.

Buyer Protection

If a verified breach of exclusive licensing occurs, such as duplicate exclusive sales, unauthorized relicensing, or outside-platform resale, Tacticool Art may provide buyer protection remedies.

A verified exclusive breach may make the affected buyer eligible for a full refund and, where appropriate, additional corrective measures or marketplace credit at the platform’s discretion.

Vendor Enforcement

Verified violations of exclusive licensing rules may result in seller enforcement actions.

These actions may include product removal, listing suspension, payout review, withdrawal restriction, loss of exclusive selling privileges, account suspension, or permanent marketplace removal.

A vendor’s denial alone does not automatically invalidate a claim. Tacticool Art may determine outcomes based on available evidence, platform records, investigation findings, and reasonable judgment.

Separate Policies

This License Framework is supported by separate marketplace documents, including:

  • Commercial License
  • Exclusive Commercial License
  • Ownership Transfer Policy
  • Exclusive Integrity Protection Policy
  • Vendor Agreement
  • Terms & Conditions

If there is a conflict between this general framework and a more specific license agreement or written ownership transfer agreement, the more specific agreement may apply.
