Exclusive Integrity Protection

Tacticool Art recognizes that trust is especially important when purchasing Exclusive digital products.

The Exclusive Integrity Protection framework is intended to support buyer confidence, marketplace accountability, licensing integrity, and responsible vendor participation within the Tacticool Art ecosystem.

Purpose of Exclusive Integrity Protection

Exclusive products are intended for one buyer only under the applicable Tacticool Art Exclusive Commercial License framework.

The purpose of Exclusive Integrity Protection is to help address situations involving suspected exclusivity conflicts, duplicate exclusive sales, unauthorized relicensing, outside-platform duplication, or other violations of exclusive marketplace obligations.

Exclusive Seller Commitments

Vendors offering products under an Exclusive model are expected to comply with elevated exclusivity standards.

By listing a product as Exclusive, vendors represent and warrant that the applicable product:

  • has not previously been sold as Exclusive to another party;
  • is not knowingly subject to conflicting Exclusive rights;
  • is not simultaneously offered under conflicting Exclusive availability elsewhere;
  • will not be duplicated, relicensed, privately resold, or transferred in violation of the applicable Exclusive license.

Suspected Integrity Breaches

Examples of situations that may give rise to an Exclusive Integrity review may include:

  • Duplicate Exclusive Sales
  • Unauthorized Relicensing
  • Outside-Platform Exclusive Duplication
  • Conflicting Exclusive Ownership Claims
  • Misrepresentation of Exclusive Status
  • Conflicting Marketplace Availability
  • Other Potential Exclusivity Violations

Buyer Claims & Reporting

A buyer who discovers a suspected exclusivity conflict may submit an Exclusive Integrity Claim for platform review.

Claims may include supporting information such as:

  • Purchase Records
  • Marketplace Links
  • Screenshots
  • Listing Evidence
  • File Comparisons
  • Communications
  • Other Relevant Documentation

Submitting a claim does not automatically establish a verified violation.

Investigation Process

Tacticool Art may review suspected integrity claims using available evidence, platform records, seller information, marketplace history, transaction records, investigation findings, and reasonable administrative judgment.

Where appropriate, vendors may be given an opportunity to respond, clarify, provide evidence, or participate in the review process.

Platform investigations may involve internal review, evidence comparison, marketplace analysis, or other reasonable verification measures.

Evidence Standard

Exclusive Integrity reviews are conducted using a reasonable evidence framework.

Platform review may consider:

  • Available Documentation
  • Purchase History
  • Platform Records
  • Listing Similarity
  • Metadata & Supporting Information
  • External Marketplace Evidence
  • Chronology & Transaction Timing
  • Relevant Investigation Findings

A vendor’s denial alone does not automatically invalidate a claim.

Buyer Protection

If a verified breach of Exclusive licensing integrity occurs, affected buyers may be eligible for buyer protection remedies.

Buyer protection measures may include:

  • Full Refund Eligibility
  • Corrective Resolution Measures
  • Marketplace Credit or Goodwill Remedies
  • Platform Investigation Support
  • Other Reasonable Corrective Measures

Applicable remedies may depend on the circumstances of the matter, available evidence, investigation findings, and marketplace policies.

Vendor Enforcement Measures

Verified violations involving Exclusive licensing integrity may result in enforcement action.

Potential enforcement measures may include:

  • Product Removal
  • Listing Restriction
  • Payout Review or Freeze
  • Withdrawal Restriction
  • Loss of Exclusive Selling Privileges
  • Account Restriction
  • Seller Suspension
  • Permanent Marketplace Removal Eligibility

Enforcement outcomes may vary depending on the severity, circumstances, investigation findings, prior conduct, marketplace risk considerations, and platform judgment.

Intentional Misconduct

Intentional duplicate Exclusive sales, fraudulent exclusivity claims, unauthorized relicensing, deliberate marketplace deception, or comparable misconduct may be treated as severe marketplace violations.

Serious integrity violations may result in escalated enforcement action.

False Claims & Abuse Prevention

Tacticool Art also seeks to maintain fairness within the claims process.

Knowingly false claims, abusive reporting behavior, fabricated evidence, malicious misuse of the reporting system, or other improper conduct may itself be subject to review and enforcement action.

Platform Authority

Tacticool Art reserves the right to determine claim outcomes, applicable remedies, enforcement measures, review procedures, and administrative actions based on available evidence, investigation findings, platform records, marketplace considerations, and reasonable judgment.

Platform determinations made within the scope of marketplace administration may influence the handling of claims, seller participation status, buyer protection measures, and licensing integrity decisions.

Relationship to Other Policies

Exclusive Integrity Protection operates alongside the broader Tacticool Art marketplace framework, including:

  • License Framework
  • Exclusive Commercial License
  • Commercial License
  • Vendor Agreement
